1. Acceptance of Terms

By accessing and using ForgedDigitalDesign services, you accept and agree to be bound by the terms and provision of this agreement.

2. Services Provided

ForgedDigitalDesign provides web design, web development, and related digital services including:

  • Custom website design and development
  • Website maintenance and updates
  • Search engine optimization (SEO)
  • Digital consulting services
  • Technical support and training

3. Client Responsibilities

Clients are responsible for:

  • Providing accurate and complete project information
  • Timely provision of content, images, and other materials
  • Prompt communication and feedback during development
  • Payment of invoices according to agreed terms
  • Maintaining their own content and data backups

4. Payment Terms

Payment terms are as follows:

  • Project deposits are required before work begins
  • Final payment is due upon project completion
  • Late payments may incur additional charges
  • Disputed charges must be reported within 30 days

5. Project Timeline

Project timelines are estimates based on client cooperation and prompt provision of required materials. Delays caused by client factors may affect delivery schedules.

6. Intellectual Property

Upon full payment:

  • Clients receive rights to custom design elements created specifically for their project
  • ForgedDigitalDesign retains rights to general methodologies, techniques, and processes
  • Third-party components remain subject to their respective licenses
  • ForgedDigitalDesign may showcase completed work in portfolio

7. Website Hosting and Maintenance

Unless otherwise agreed:

  • Clients are responsible for their own hosting arrangements
  • We can recommend reliable hosting providers
  • Maintenance services are available under separate agreement
  • We provide basic technical support for 30 days post-launch

8. Limitation of Liability

ForgedDigitalDesign's liability is limited to the amount paid for services. We are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of business, profits, or data
  • Issues arising from client-provided content or materials
  • Third-party service failures or downtime

9. Cancellation and Refunds

Project cancellation terms:

  • Work completed to date will be billed
  • Deposits are non-refundable after work begins
  • Clients receive files for work completed and paid for
  • 30-day notice required for ongoing service cancellations

10. Warranty and Support

We provide:

  • 30-day warranty on development work against defects
  • Basic technical support during warranty period
  • No warranty on third-party components or services
  • Extended support available under separate agreement

11. Confidentiality

We maintain strict confidentiality of client information and will not disclose proprietary business information to third parties without consent.

12. Force Majeure

Neither party shall be liable for delays or failures caused by circumstances beyond reasonable control, including natural disasters, government actions, or technical failures.

13. Governing Law

These terms are governed by the laws of South Carolina, United States. Any disputes shall be resolved in the courts of South Carolina.

14. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated effective date.
